Terms of Service – Bobby Built Roofing

Welcome to the official Terms of Service for Bobby Built Roofing, a professional roofing and exterior renovation contractor serving Moncton and surrounding areas of New Brunswick.
These Terms of Service form a legally binding agreement between Bobby Built Roofing and the client.
By accepting a quote, signing an estimate, approving work, or submitting payment, you acknowledge that you have read, understood, and agreed to the terms outlined below.
1. Definitions
- Company refers to Bobby Built Roofing.
- Client refers to the individual or entity requesting services.
- Scope of Work refers to the services listed in the approved estimate or contract.
- Project refers to all work performed under the agreed Scope of Work.
2. Scope of Work
Bobby Built Roofing will perform only the services explicitly outlined in the approved estimate or contract.
If you request work outside of the Scope of Work, we will provide a written change order with revised pricing and timelines.
Furthermore, additional work may require updated terms, which we will clearly communicate before proceeding.
3. Scheduling and Delays
We schedule projects based on weather conditions, material availability, site access, and other factors.
However, estimated start and completion dates are approximate.
We cannot guarantee them because unforeseen circumstances may occur.
Additionally, delays may result from client-requested changes, undisclosed site conditions, or supplier delays.
4. Permits and Code Compliance
Unless we agree otherwise in writing, the Client must obtain all required permits, approvals, and inspections.
We will complete all work in compliance with applicable New Brunswick building codes and industry standards.
5. Insurance and Liability
Bobby Built Roofing maintains all required insurance coverage.
While we take reasonable care to protect property, the Client must acknowledge that pre-existing conditions or hidden damage may exist.
Also, roofing and exterior renovation work involves inherent risks that the Client should understand.
6. Payment Terms
Payment terms appear in the approved estimate or invoice and may include deposits, progress payments, or final balances.
Invoices are due on the dates specified.
Late payments may incur interest.
As a result, we reserve the right to suspend work if payments are not received.
Additionally, all payments are non-refundable once we begin work or order materials.
7. Change Orders
We require written approval from both parties for any modifications to the original Scope of Work.
Change orders may affect pricing and project timelines.
Furthermore, we communicate all changes clearly before proceeding.
8. Warranties
Bobby Built Roofing provides a workmanship warranty as outlined in the estimate or contract.
Manufacturer warranties apply only to materials and follow the manufacturer’s terms.
Also, warranties do not cover damage caused by acts of nature, improper maintenance, third-party alterations, or normal wear and tear.
9. Site Conditions and Property Protection
The Client must remove valuables, secure fragile items, and ensure clear access to the work area.
We take reasonable precautions, but we are not liable for minor incidental damage typical of construction activities.
10. Termination of Services
Bobby Built Roofing may terminate services if the Client breaches these Terms of Service, including failing to make payment or refusing to provide a safe work environment.
The Client remains responsible for payment for all completed work and materials incurred up to the termination date.
11. Limitation of Liability
To the fullest extent permitted by law, Bobby Built Roofing is not liable for indirect, incidental, or consequential damages.
Our total liability will not exceed the total contract value for the services provided.
12. Governing Law
These Terms of Service follow the laws of the Province of New Brunswick, Canada.
As a result, all disputes will be interpreted under New Brunswick law.
13. Acceptance of Terms
By approving an estimate, signing a contract, or submitting payment, the Client confirms acceptance of these Terms of Service in full.
